Brazilian concerns have increased amid unemployment caused by the COVID-19 pandemic over the past two years. What many people don't know is that unemployed workers may also be entitled to sick pay.
Benefit - sickness and unemployed
First of all, it is important to understand what the law says. To be entitled to the benefit, you must be totally or temporarily disabled, have a waiting period of at least 12 months and be insured.
In other words, unemployed women can receive sick pay while they are still on maternity leave. This means that the person is still considered insured, even if they are no longer contributing to the National Social Security Institute (INSS) at that time.

Once the employment relationship ends, the citizen has a waiting period of up to 12 months. Another interesting point guaranteed by law is in cases where the person has 120 uninterrupted contributions or more, as the grace period increases to 24 months in these contexts.
For this reason, the law also grants eligibility for sickness benefit to unemployed people, as long as they meet the required requirements. It must also be remembered that incapacity for work cannot simply be claimed. It must be confirmed by a medical report from the INSS.
Another way for individuals to guarantee their right to the benefit is if they choose to continue with the charge as optional. Unemployed people must apply for sickness benefit as soon as they are examined and proven to be temporarily incapable of working.
If the request is rejected by the INSS, the citizen has the right to challenge the Institute's decision. This can be done through an administrative complaint to the INSS itself or through legal action.
